Marathon Bombing Suspect Charged; Penn Wood High Resuming; 15 Months for Hoax Call; Chel Heroin Bust

Dzhokhar Tsarnaev was formally charged in the Boston Marathon bombing on Monday. A magistrate judge went to Beth Israel Deaconess Medical Center to conduct the initial court appearance for Tsarnaev who is in serious condition with gunshot wounds to his throat and leg. He is unable to speak and can only respond by writing. Specifically, Dzhokhar is charged with one count of using and conspiring to use a weapon of mass destruction against persons and property within the United States resulting in death, and one count of malicious destruction of property by means of an explosive device resulting in death. These charges carry the possibility of the death penalty. Tsarnaev, a naturalized US citizen, will not be tried as an enemy combatant, he will be tried in civilian court. As of right now he is under heavy guard and security.

Classes will resume on Wednesday for students of Penn Wood High School in Lansdowne after an arson fire early Thursday damaged the lobby and several classrooms. Before the fire damaged the William Penn School District building in Lansdowne, juniors and seniors attended the Lansdowne campus and freshmen and sophomores went to the campus in Yeadon. Students will now attend split sessions at the Cypress Street campus in Yeadon for the rest of the year with upperclassmen attending in the morning and underclassmen in the afternoon. Investigators are still looking for individuals involved in setting the arson fire last week.

A Philadelphia pizza cook who called in a hoax airplane threat to Philadelphia International Airport to get back at a romantic rival gets 15 months in prison. Kenneth Smith also has to pay $17,000 in restitution and write apology letters to the 38 passengers whose plane was turned around and stormed with armed agents. Smith, 26, was angered over a compromising photo that rival Christopher Shell, 26, had posted on Facebook of his girlfriend. To get back at Shell, Smith called PHL on September 6th to tell them that Shell had carried liquid explosives with him on a flight to Dallas. That flight was already over Harrisburg and was detoured back to Philadelphia, where Shell was dragged out of the plane only to be cleared of wrongdoing and allowed to fly. (Ironically, Shell was arrested when he eventually arrived in Dallas because he had an outstanding warrant that was brought to light by the commotion.) The judge told Smith to spend more time looking at the mirror, and less time looking at Facebook

A traffic stop in Cheltenham, Montgomery County, on Sunday led to the discovery of 4 kilograms of heroin. 34-year-old Frankie Melecio Laboy was pulled over in his Chrysler 300 for traffic violations at 8:15pm. He was allegedly nervous and uncooperative. A background check revealed an outstanding warrant in Florida for receiving stolen property. Laboy's car was impounded and after a search warrant was obtained on Monday investigators discovered the heroin hidden in the trunk. They estimate that it has a street value of $1.2 million. Laboy faces a charge of possession with intent to deliver.
