The sexual assault case against actor Bill Cosby is moving forward. And a key battle will be waged over explicit testimony he gave in a deposition more than a decade ago. Bill Cosby was back in Montgomery County court Wednesday. This was the second day of a hearing on a defense motion to throw out charges against Cosby. Judge Steven T. O'Neill ruled at the end of the day that the case should proceed to trial. The basis of the motion comes from a 2005 'promise' from then District Attorney Bruce Castor to Cosby that he would not be prosecuted if he testified in a civil lawsuit brought by the complainant. Bill Cosby is scheduled to be in a Montgomery County courtroom today to argue sex assault charges against him should be dropped. Attorneys for the 78-year-old comedian claim the charges are based on a deposition from a civil trial in 2005, which they say is protected by a so-called "non-prosecution agreement" with then-District Attorney Bruce Castor.
